Welcome to MannApp!

These Terms of Service (“Terms”) govern your access to and use of the MannApp platform, including its website, applications, and related services (collectively, the “Services”) provided by Crafted Solutions Limited (“Crafted Solutions,” “we,” “us,” or “our”).

By creating an account, accessing, or using our Services, you agree to be bound by these Terms and our Privacy Policy (available at https://mann.app/privacy), which is incorporated by reference into these Terms. If you do not agree to these Terms, do not access or use our Services.

1. Description of MannApp Services

MannApp is a community platform designed for residents of, and visitors to, the Isle of Man. It provides services including local information sharing, event discovery and booking, and a marketplace for local and online commerce.

2. Eligibility and User Accounts

2.1. Account Requirement

To access the full functionality of MannApp and interact with its services, you must register for an account. Some limited information or read-only data may be accessible via the public website without an account.

2.2. Age Requirement

You must be at least thirteen (13) years of age to create a main account on MannApp. If you are between the ages of 13 and 18 (or the age of majority in your jurisdiction), you may only use the Services under the supervision of a parent or legal guardian who agrees to be bound by these Terms. Functionality specifically designed for younger children, if any, will require verifiable parental consent as outlined in our Privacy Policy.

2.3. Geographic Scope

There are no specific geographic restrictions for creating an account, though the Services are primarily targeted towards residents of and visitors to the Isle of Man.

2.4. Account Responsibilities

  • Accurate Information: You agree to provide true, accurate, current, and complete information about yourself as prompted by the MannApp registration process and to maintain and promptly update your registration data to keep it true, accurate, current, and complete.
  • Account Security: You are responsible for maintaining the confidentiality of your account password and are fully responsible for all activities that occur under your account. You agree to immediately notify Crafted Solutions Limited at support@mann.app of any unauthorised use of your password or account or any other breach of security.
  • No Account Sharing: You may not share your account credentials or allow others to access your account.
  • Account Deletion: You can request the deletion of your account by visiting https://mann.app/deletion or by emailing deletion@mann.app, subject to our Privacy Policy and data retention practices.

3. Acceptable Use Policy

You agree not to use MannApp for any purpose that is unlawful or prohibited by these Terms, or any other purpose not reasonably intended by Crafted Solutions Limited. Prohibited activities include, but are not limited to:

  • Engaging in any illegal activities or promoting illegal acts.
  • Posting, uploading, or distributing content that is unlawful, defamatory, libellous, abusive, harassing, hateful, obscene, harmful to minors, an invasion of privacy or publicity rights, or otherwise objectionable.
  • Infringing on the intellectual property rights (copyrights, trademarks, patents, trade secrets, etc.) or other proprietary rights of any party.
  • Transmitting spam, chain letters, junk mail, or other unsolicited communications.
  • Attempting to interfere with, disrupt, or compromise the integrity or security of MannApp, its servers, or networks (e.g., uploading viruses, denial-of-service attacks, unauthorised scraping, hacking, or data mining).
  • Impersonating any person or entity or falsely stating or otherwise misrepresenting your affiliation with a person or entity.
  • Collecting or storing personal data about other users without their consent or in violation of applicable law or our Privacy Policy.
  • Engaging in fraudulent activities, especially concerning marketplace listings, event bookings, or any commercial transactions on MannApp.
  • Violating any specific rules or codes of conduct associated with events or marketplace transactions.
  • Creating events that are intended to take place outside the jurisdiction of the Isle of Man.
  • Using the Services in any manner that could disable, overburden, damage, or impair the Services or interfere with any other party’s use of the Services.

Violation of this Acceptable Use Policy may result in, among other things, termination or suspension of your rights to use the Services and removal of your content.

4. User-Generated Content

4.1. Ownership

You retain ownership of the original intellectual property rights in any content you submit, post, display, or otherwise make available on or through MannApp (“User Content”).

4.2. Licence to Crafted Solutions Limited

By submitting User Content on or through MannApp, you grant Crafted Solutions Limited a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable, and transferable licence to use, host, store, reproduce, modify (e.g., for formatting purposes to ensure it displays correctly on MannApp), adapt, publish, translate, create derivative works from, distribute, perform, and display such User Content in connection with operating, providing, developing, and promoting the MannApp Services and our business. This licence continues even if you stop using our Services, with respect to aggregate and de-identified data and any residual backup copies.

4.3. AI Model Training

You explicitly grant Crafted Solutions Limited full permission to use your data, including User Content and other information you provide or that is generated through your use of MannApp, for the purpose of training, developing, and improving artificial intelligence models and related technologies developed or used by Crafted Solutions Limited. This use is further described in our Privacy Policy.

4.4. Responsibility for User Content

You are solely responsible for your User Content and the consequences of posting or publishing it. You represent and warrant that you have all necessary rights, licences, consents, and permissions to publish User Content you submit and to grant the licences set forth in these Terms. Crafted Solutions Limited does not endorse and has no control over User Content. We reserve the right, but are not obligated, to remove or modify User Content for any reason, including User Content that we believe violates these Terms or our policies.

5. Intellectual Property Rights of MannApp

5.1. Ownership

All rights, title, and interest in and to the MannApp Services (excluding User Content) including, but not limited to, the software, design, text, graphics, logos, trademarks, service marks, trade names, and other content created by Crafted Solutions Limited (“MannApp IP”), are and will remain the exclusive property of Crafted Solutions Limited and its licensors. MannApp is protected by copyright, trademark, and other laws of the Isle of Man and foreign countries.

5.2. Limited Licence to Users

Subject to your compliance with these Terms, Crafted Solutions Limited grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use MannApp solely for your personal, non-commercial use, or as otherwise explicitly permitted for certain platform features (e.g., for sellers in the marketplace for their commercial activities on the platform).

5.3. Restrictions

You may not copy, modify, distribute, sell, lease, reproduce, create derivative works from, reverse engineer, decompile, or otherwise attempt to extract the source code of the MannApp platform or any part thereof, unless laws prohibit these restrictions or you have our written permission.

5.4. Use of Branding Materials

The use of official MannApp or Crafted Solutions Limited branding and design materials (e.g., logos, trademarks) in print, online, or any other media requires prior explicit written permission from Crafted Solutions Limited. Requests for such permission should be directed to contact@mann.app.

6. Payment Terms

6.1. Fees and Charges

Access to certain features of MannApp may require you to pay fees. These may include, but are not limited to:

  • Fees for listing items or services in the marketplace.
  • Transaction fees applicable to sellers upon successful sales.
  • Subscription fees for accessing premium features or specific service tiers.
  • The purchase price for items, services, or event tickets bought through MannApp.
  • MannApp may also charge consumers a platform fee or service fee which will be added to the advertised price of goods or services offered for sale by third parties or by us.

All applicable fees, including any taxes, will be clearly disclosed to you before you complete a transaction or incur a charge.

6.2. Payment Processing

Payments made on MannApp will be processed through a designated third-party payment processor (the “Payment Processor”). The specific Payment Processor is to be determined and may not be available at the initial launch of certain payment-enabled features. By making payments through MannApp, you agree to provide valid payment information and to be bound by the terms and conditions of the then-current Payment Processor. Crafted Solutions Limited does not collect or store your full credit/debit card details. That information is provided directly to our Payment Processor.

6.3. Subscriptions

  • Billing Cycle: If you purchase a subscription, it may be offered on a monthly (auto-renewing) or annual basis, as selected by you at the time of purchase.
  • Auto-Renewal: Unless you cancel your subscription before the end of the current subscription period, your subscription will automatically renew for an additional period of the same duration. You authorise us to charge your chosen payment method for the renewal.
  • Cancellation: You may cancel your subscription at any time through your user Billing dashboard on MannApp or by contacting support@mann.app. Cancellation will be effective at the end of your current billing period. No refunds or credits will be provided for any partial subscription periods, unless otherwise required by applicable law or explicitly stated by us.

6.4. Refunds and Cancellations (for non-subscription purchases)

  • Refund and cancellation policies for items, services, or event tickets purchased through MannApp may vary depending on the specific offering and the terms set by the seller or event organiser.
  • Any specific refund or cancellation terms applicable to a purchase will be made available at the time of the transaction or by the relevant third-party seller/organiser.
  • For disputes or refund requests where specific terms are not provided or are unclear, please contact MannApp support at support@mann.app. While we may endeavour to facilitate a resolution, Crafted Solutions Limited is not directly responsible for refunds related to transactions between users or with third-party event organisers or sellers, except where explicitly stated or required by applicable law.

6.5. Taxes

All fees are exclusive of applicable taxes (e.g., Value Added Tax - VAT), unless stated otherwise. Where applicable, taxes will be added to the price at the point of transaction and itemised on receipts. You are responsible for determining and fulfilling your own tax obligations (including reporting and payment of any applicable taxes) arising from your activity on MannApp, whether as a buyer or a seller. Crafted Solutions Limited is responsible for its own tax obligations on fees it charges directly.

7. Term and Termination

7.1. Term

These Terms shall become effective upon your first use of the Services or when you create an account, and shall remain in full force and effect while you use the Services or maintain an account.

7.2. Termination by You

You may terminate your agreement with Crafted Solutions Limited at any time by closing your MannApp account (through the account deletion process at https://mann.app/deletion or by emailing deletion@mann.app) and/or by ceasing all use of the Services.

7.3. Termination or Suspension by Crafted Solutions Limited

Crafted Solutions Limited may, in its sole discretion, suspend or terminate your account and/or access to all or part of MannApp at any time, with or without prior notice or liability, for any reason or no reason, including but not limited to:

  • If you breach any provision of these Terms or the Privacy Policy.
  • If you engage in illegal, fraudulent, or abusive activities.
  • Upon request by law enforcement or other government agencies.
  • For extended periods of inactivity (as determined by us).
  • Due to unexpected technical or security issues or problems.
  • If we discontinue or materially modify the MannApp Services.
  • For non-payment of any fees owed by you in connection with MannApp.

7.4. Consequences of Termination

Upon termination of your account or access to the Services:

  • Your right to access and use MannApp will immediately cease.
  • Crafted Solutions Limited may, in its discretion, delete your account information and User Content associated with your account, subject to our legal obligations and data retention policies outlined in the Privacy Policy. You are solely responsible for retaining copies of any User Content you wish to preserve.
  • Any fees paid by you prior to termination are generally non-refundable, unless otherwise stated in these Terms or required by applicable law.
  • The following provisions of these Terms will survive termination: User-Generated Content (including the licence and AI training permission), Intellectual Property Rights of MannApp, Payment Terms (for any outstanding obligations), Disclaimers of Warranties, Limitation of Liability, Indemnification, Governing Law and Dispute Resolution, and Miscellaneous provisions.

8. Disclaimers of Warranties

THE MANNAPP SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, CRAFTED SOLUTIONS LIMITED AND ITS AFFILIATES, LICENSORS, SUPPLIERS, ADVERTISERS, SPONSORS AND AGENTS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE, AND ANY WARRANTIES IMPLIED BY ANY COURSE OF PERFORMANCE OR USAGE OF TRADE.

CRAFTED SOLUTIONS LIMITED DOES NOT WARRANT THAT: (A) THE SERVICES WILL BE SECURE OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; (B) ANY DEFECTS OR ERRORS WILL BE CORRECTED; (C) THE SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (D) THE RESULTS OF USING THE SERVICES WILL MEET YOUR REQUIREMENTS. YOUR USE OF THE SERVICES IS SOLELY AT YOUR OWN RISK.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CRAFTED SOLUTIONS LIMITED, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (C) ANY CONTENT OBTAINED FROM THE SERVICES; AND (D) UNAUTHORISED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF CRAFTED SOLUTIONS LIMITED AND ITS AFFILIATES FOR ALL CLAIMS RELATING TO THE SERVICES OR ARISING OUT OF OR IN CONNECTION WITH THESE TERMS SHALL NOT EXCEED THE GREATER OF: (I) THE TOTAL AMOUNT OF FEES, IF ANY, PAID BY YOU TO CRAFTED SOLUTIONS LIMITED FOR THE USE OF THE MANNAPP SERVICES DURING THE THREE (3) MONTH PERIOD IMMEDIATELY PRECEDING THE DATE OF THE CLAIM; OR (II) ONE HUNDRED MANX POUNDS (£100.00).

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

10. Indemnification

You agree to defend, indemnify, and hold harmless Crafted Solutions Limited, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgements, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to your violation of these Terms of Service or your use of MannApp, including, but not limited to, your User Content, any use of MannApp’s content, services, and products other than as expressly authorised in these Terms, or your use of any information obtained from MannApp.

11. Governing Law and Dispute Resolution

11.1. Governing Law

These Terms of Service and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Isle of Man, without regard to its conflict of law principles.

11.2. Informal Dispute Resolution

We want to address your concerns without needing a formal legal case. Before filing a claim against Crafted Solutions Limited, you agree to try to resolve the dispute informally by contacting support@mann.app. We’ll try to resolve the dispute informally by contacting you via email or telephone. If a dispute is not resolved within sixty (60) days after submission, you or Crafted Solutions Limited may bring a formal proceeding.

11.3. Mediation/Arbitration

If the dispute cannot be resolved informally, both parties agree to consider in good faith mediation or binding arbitration as a next step, under rules to be mutually agreed upon or, if applicable, administered by a recognised Isle of Man arbitration or mediation body, before resorting to litigation.

11.4. Jurisdiction

Subject to the provisions for informal resolution and mediation/arbitration, you and Crafted Solutions Limited agree that any legal suit, action, or proceeding arising out of, or related to, these Terms of Service or the Services shall be instituted exclusively in the courts of the Isle of Man. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts. This applies to all users, including those accessing MannApp from the UK or other global locations.

12. Changes to Terms of Service

Crafted Solutions Limited reserves the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least thirty (30) days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

We will notify you of any material changes through a combination of methods, which may include:

  • Posting the updated Terms on the MannApp website and/or app with a new effective date.
  • Sending an email notification to registered MannApp users.
  • Displaying an in-app or on-site notification within MannApp.

By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, in whole or in part, please stop using the website and the Services. We encourage you to review these Terms periodically for any updates or changes.

13. Miscellaneous

13.1. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or additional terms and conditions or policies published by us on the Services, shall constitute the entire agreement between you and Crafted Solutions Limited concerning the Services. These Terms supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to the Services.

13.2. Severability

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

13.3. Waiver

No waiver by Crafted Solutions Limited of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Crafted Solutions Limited to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

13.4. Assignment

These Terms, and any rights and licences granted hereunder, may not be transferred or assigned by you without the prior written consent of Crafted Solutions Limited. Crafted Solutions Limited may assign its rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, sale of assets, or by operation of law.

13.5. Force Majeure

Crafted Solutions Limited shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond Crafted Solutions Limited’s reasonable control, including, without limitation, mechanical, electronic, or communications failure or degradation, acts of God, war, riot, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labour, or materials, or pandemics/epidemics.

13.6. Headings and Interpretation

The section headings and titles in these Terms are for convenience only and shall not affect their interpretation.

13.7. No Third-Party Beneficiaries

These Terms do not and are not intended to confer any rights or remedies upon any person other than you and Crafted Solutions Limited, unless explicitly stated otherwise.

13.8. Specific Service Rules

Please note that certain services or features offered on MannApp may be subject to additional guidelines, rules, or terms, which will be provided to you in conjunction with those services or features. By using such services or features, you agree to comply with such additional guidelines, rules, or terms.
